NDRC Issues Measures on Outbound Investment Management

36Kr1 min read

36Kr learned that the National Development and Reform Commission (NDRC) has issued measures on outbound investment management. The measures state that the filing-based management applies to non-sensitive outbound investments made directly by investors, meaning non-sensitive outbound investments that involve investors directly contributing assets or equity, or providing financing or guarantees. If the investor is a centrally administered enterprise, the filing authority is the NDRC. If the investor is a local enterprise and the Chinese investment amount is US$300 million or more, the filing authority is the NDRC. If the investor is a local enterprise and the Chinese investment amount is less than US$300 million, the filing authority is the provincial-level development and reform department where the investor is registered. If the investor is another type of organization, it follows the rules applicable to enterprises. If the investor is an individual resident, the filing authority is the provincial-level development and reform department of the investor's household registration location or habitual residence. For outbound investments within the scope of filing management, investors must obtain an outbound investment filing notice before implementing the investment.
