HK SFC: Will strengthen targeted tools to tackle misconduct in IPOs and other corporate activities
The Hong Kong Securities and Futures Commission (SFC) has published a consultation summary, stating it will enhance targeted tools under the Securities and Futures (Listing Rules of the Stock Exchange) Ordinance to address initial public offering cases and post-listing matters, thereby improving regulatory efficiency and investor protection in Hong Kong's listed market. The revisions will allow the SFC to impose conditions on listing applicants that remain applicable after listing, and impose post-listing conditions on listed issuers as an alternative to immediate trading suspensions, while also streamlining procedures for resuming trading. Additionally, the SFC will introduce a new mechanism for the Securities and Futures Appeal Tribunal to independently review SFC decisions made under the Stock Exchange Listing Rules (including those related to imposing conditions, suspensions, and resumption of trading), enhancing procedural fairness and transparency.
